Georgia DUI Breath Tests

In the state of Georgia, it is illegal to drive while under the influence of any intoxicating substance, such as alcohol, drugs or even prescription medications that impair judgment. Additionally, it is illegal to drive with a blood alcohol concentration of 0.08%. The latter is known as a per se offense and if people have a BAC of 0.08% or higher, prosecutors just have to prove that people had unlawful amount of alcohol or drugs in their systems.

To gather evidence, prosecutors will usually rely upon breath tests. Whenever police officers have reason to believe that people were DUI, they will ask them to take a breath test. People who take breath tests will blow into what is called a "breathalyzer" and officers will then have their BAC reading.

If people have a BAC reading of 0.08% or higher, they will automatically be arrested for driving under the influence and may be subjected to formal charges. In order to fight their charges, people will need help from a skilled Gwinnet County criminal defense lawyer, like Attorney Douglas N. Fox.
